Landscaping Terms & Conditions

CEC Outdoor Services, LLC

Residential Service Terms & Conditions
Macomb County, Michigan

These Service Terms & Conditions apply to estimates, quotes, invoices, service agreements, work orders, and services performed by CEC Outdoor Services, LLC. By approving a quote or estimate, scheduling service, making payment, or allowing work to begin, the Customer agrees to these Terms & Conditions.

1. Scope of Services

Services are limited to those listed in the Customer's quote, estimate, invoice, or service agreement. Additional work requested by the Customer may result in additional charges.

The Customer's quote or service agreement will establish the specific services, frequency, and pricing for the property.

2. Recurring Services

Customers enrolled in recurring lawn or property services will be serviced according to the frequency stated in their quote or service agreement.

Service schedules may be adjusted due to weather, turf conditions, holidays, equipment issues, route scheduling, or other circumstances that prevent safe or practical service. CEC Outdoor Services does not guarantee a specific arrival time.

3. Monthly Billing for Recurring Customers

Recurring service customers will be billed monthly. Services completed during the month will be invoiced on the last day of that month at the agreed-upon rates stated in the Customer's quote or service agreement.

Invoices are due within ten (10) calendar days of the invoice date unless otherwise stated in writing. CEC Outdoor Services may suspend future service on past-due accounts until the account is brought current.

Additional or one-time services may be invoiced separately.

4. One-Time Services

Unless otherwise stated in the quote or estimate, payment for one-time services is due upon completion.

One-time services may include fall cleanups, hedge trimming, yard cleanups, overgrown lawn service, or other services not included in a recurring service agreement.

5. Payment Methods

Accepted payment methods may include cash, check, electronic payment, and major credit or debit cards. Returned payments and overdue balances may be subject to reasonable fees where permitted by law.

6. Scheduling

Services are scheduled based on route efficiency, weather, equipment availability, property conditions, and safe working conditions. Scheduled service days are approximate and may change. Weather delays may cause service to be completed on a different day.

7. Customer Responsibilities

Customers are responsible for providing reasonable access to the property on scheduled service days.Customers must remove toys, hoses, decorations, pet waste, and other movable objects from service areas; secure pets; unlock gates or otherwise provide access; keep vehicles and other obstructions clear of areas requiring service; and identify sprinkler heads, invisible fences, septic systems, utility covers, landscape lighting, drainage components, and other hidden or unusual property features.

CEC Outdoor Services may skip or reschedule a property when safe or reasonable access is unavailable.

8. Property Conditions and Hidden Objects

CEC Outdoor Services is not responsible for damage to hidden, buried, unmarked, improperly installed, or improperly maintained objects or property features that could not reasonably be identified during normal service.

This may include sprinkler components, invisible fences, landscape lighting, utility components, drainage systems, cables, hoses, toys, landscape edging, or other objects located within the service area.

CEC Outdoor Services is not responsible for pre-existing property damage or lawn conditions resulting from disease, insects, drought, weeds, excessive moisture, or other conditions outside its control.

9. Overgrown Lawns and Unusual Conditions

Standard mowing pricing assumes the property is reasonably maintained. Grass exceeding approximately eight (8) inches, excessive overgrowth, excessive debris, unusually wet conditions, or neglected properties may require additional time and may result in an additional charge.

CEC Outdoor Services may decline or postpone service when property conditions could create an unreasonable safety risk or risk of equipment or property damage.

10. Lawn Mowing

Recurring lawn mowing includes only the services specifically identified in the Customer's quote or service agreement. Weather, seasonal growth rates, drought, or turf conditions may affect mowing schedules.

CEC Outdoor Services may postpone mowing when completing service could cause excessive turf damage, rutting, or unsafe operating conditions.

11. Fall and Yard Cleanups

Cleanup services are based on the scope described in the Customer's quote or estimate. Additional debris, leaves, branches, materials, or conditions not reasonably visible when the estimate was prepared may require additional charges with Customer approval.

Leaf and debris removal or disposal is included only when specifically stated in the quote.

12. Hedge and Shrub Trimming

Hedge and shrub trimming is limited to the plants and work described in the Customer's quote or estimate. CEC Outdoor Services is not responsible for pre-existing plant disease, dead material, concealed objects, or plant conditions that are not reasonably visible before work begins.

13. Snow Removal

Snow removal services, when offered, will be governed by the specific scope, pricing, service trigger, and other conditions stated in the Customer's snow removal quote or service agreement.

CEC Outdoor Services cannot guarantee completely bare or ice-free pavement following snow removal. Snow and ice conditions may create slippery surfaces before, during, and after service. Customers remain responsible for exercising reasonable care when using driveways, sidewalks, steps, and other exterior surfaces.

14. Damage or Service Concerns

Customers should report workmanship concerns or alleged property damage within five (5) calendar days of discovering the issue.

CEC Outdoor Services must be given a reasonable opportunity to inspect an alleged damage claim before repairs are performed by another party, except where immediate action is reasonably necessary to prevent additional damage or address a safety issue.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

15. Photographs

CEC Outdoor Services may take photographs of a property before, during, or after service for documentation, quality control, estimates, or insurance purposes.

Photographs identifying a Customer's property will not be used for marketing purposes if the Customer requests in writing that the property not be used for marketing.

CEC Outdoor Services maintains Commercial General Liability Insurance. Proof of insurance is available upon request.

17. Customer Cancellation of Recurring Service

Customers may request cancellation of future recurring services by contacting CEC Outdoor Services. The Customer remains responsible for services already completed and any outstanding balance.

CEC Outdoor Services requests at least 24 hours' notice for individual service cancellations when possible. Repeated cancellations, inaccessible properties, unsafe conditions, or unpaid balances may result in suspension or termination of recurring service.

18. CEC Outdoor Services' Right to Discontinue Service

CEC Outdoor Services reserves the right to decline, suspend, or discontinue service due to unsafe property conditions, abusive or threatening conduct, repeated access problems, unpaid balances, equipment limitations, or circumstances that make continued service unreasonable or unsafe.

The Customer remains responsible for payment for services completed before termination.

19. Legal Cancellation Rights

Nothing in these Terms is intended to waive or limit any cancellation, rescission, refund, or other consumer right provided under applicable Michigan or federal law.

Where a transaction is subject to a legally required cancellation period or notice requirement, those legal requirements will apply regardless of any other provision contained in these Terms.

20. Changes to Services or Pricing

Service pricing may be adjusted due to changes in property conditions, service scope, frequency, operating costs, or other circumstances. Customers will be notified of pricing changes before the new rate applies to future services.

21. Governing Law

These Terms are governed by the laws of the State of Michigan.

22. Entire Agreement

These Terms, together with the applicable quote, estimate, invoice, or service agreement, constitute the agreement between CEC Outdoor Services and the Customer regarding the services provided.

The specific scope, frequency, and pricing stated in the Customer's quote or service agreement will control if they differ from the general descriptions contained in these Terms.
